Terms of Service

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Services. By using the Services, you represent that you meet this requirement and that the information you provide is accurate.

2. The Service

QuarkFit lets you upload or record short workout videos and receive AI-generated analysis of your exercise form, posture, and movement. The Services are provided for general informational and fitness purposes only.

3. Your Content & How We Use Your Videos

You retain all ownership of the videos and other content you submit ("Your Content"). You grant us a limited, non-exclusive license to process, transmit, and store Your Content solely to provide the Services to you — namely, to generate your analysis and to give you access to your personal workout history and playback.

We will not use your videos for any other purpose. Specifically, we do not use Your Content to train AI models, we do not use it for advertising or marketing, and we do not sell, rent, or share it with third parties except the service providers strictly necessary to operate the Services (as described in our Privacy Policy). You can delete Your Content or your account at any time.

4. Accounts

You are responsible for safeguarding your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. You may delete your account at any time from within the app.

5. Acceptable Use

You agree not to:

• Upload content of any person without their consent, or content you do not have the right to submit;
• Use the Services for any unlawful, harmful, or abusive purpose;
• Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Services or their systems;
• Resell or commercially exploit the Services without our written permission.

6. Health & Fitness Disclaimer

QuarkFit provides AI-generated fitness information and is not a medical device and does not provide medical advice, diagnosis, or treatment. The analysis may be incomplete or inaccurate. Always consult a qualified healthcare professional before beginning or changing any exercise program. You assume full responsibility for any physical activity you undertake, and you use the Services at your own risk.

7. Subscriptions, Payments & Refunds

7.1 Plans & Billing

QuarkFit offers a free plan and paid subscription plans (currently "Pro" and "Max"). Each plan includes usage limits — such as the number of AI analyses per billing period and the number of stored videos — which are shown on the in-app plans page and may be updated from time to time. The price, currency, billing cycle, and any applicable taxes are always displayed at checkout before you pay. Payments are processed by Stripe; prices may be shown and charged in your local currency, and sales tax, VAT, or GST may be added based on your billing address where we are required to collect it.

7.2 Automatic Renewal

Paid subscriptions renew automatically at the end of each billing period (e.g., monthly), and your payment method is charged at the then-current price, until you cancel. By subscribing, you authorize these recurring charges.

7.3 Cancellation

You can cancel at any time in the App via Settings → Subscription → Manage subscription, which opens a self-serve billing portal — no phone call or email required. Cancellation takes effect at the end of the current billing period: you keep your paid features until then, and you will not be charged again. After cancellation your account reverts to the free plan; content exceeding free-plan limits may become inaccessible but is not deleted immediately, and you can delete it or export it at any time.

7.4 Refunds

Except where required by applicable law, payments are non-refundable and we do not provide refunds or credits for partial billing periods or unused quota. If you are a consumer in the European Union or United Kingdom, you have a statutory 14-day right of withdrawal; by purchasing, you request immediate access to the digital service and acknowledge that once the service has been fully provided your withdrawal right is lost, and that if you withdraw during the 14-day period you may be charged a proportionate amount for the service already supplied. Nothing in these Terms limits any non-waivable statutory rights in your jurisdiction.

7.5 Plan & Price Changes

You can upgrade or downgrade your plan at any time via the billing portal; changes and any proration are shown before you confirm. If we change subscription prices or materially reduce plan benefits, we will give you advance notice (e.g., by email or in-app), and the change will take effect no earlier than your next billing period — you can cancel before it applies.

7.6 App Store Purchases

Subscriptions purchased through the Apple App Store or Google Play (where available) are managed by, and subject to the terms of, those platforms, including their renewal, cancellation, and refund policies.

8. Intellectual Property

The Services, including their software, design, and content (excluding Your Content), are owned by Rowu Tech Ventures and protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Services for your personal, non-commercial use.

9. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, Rowu Tech Ventures will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Services.

11. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Services. Provisions that by their nature should survive termination will survive.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Effective Date" above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to its conflict-of-laws rules. Any disputes will be subject to the exclusive jurisdiction of the courts located in British Columbia, Canada, unless otherwise required by applicable law.
